The services provided by Redpoint Consulting Limited ("Redpoint") through the Website ("Service" or "Services") and the use of the Website are governed by these Terms and Conditions ("Terms and Conditions"). By accessing or using the Services or the Website or by registering as a bidder ("Bidder" or "User"), you agree that

  1. You have read the Terms and Conditions,
  2. You understand the Terms and Conditions, and
  3. Your use of the Services and the Website will be in accordance with the Terms and Conditions.

If you do not agree to the Terms and Conditions, you may not access or use the Services or the Website.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this contract or its subject matter or formation (including non-contractual disputes or claims)

The Terms and Conditions together with any additional terms and conditions specific to a particular auction constitute the entire agreement (the "Agreement") between Redpoint and User  and replace any earlier version of the Terms and Conditions.

Redpoint may amend  the Terms and Conditions at any time, at Redpoint's sole discretion, without notice. Any amendment of the Terms and Conditions will be displayed on the Website.  Use of the Services and the Website constitutes an acceptance of the current Terms and Conditions.

Role of Redpoint.

Redpoint provides the Services and the Website only as a service for auctioneers ("Sellers") who offer for sale items and Bidders may may bid these items. Redpoint is neither a principal with interest in the transactions, nor an agent of Bidder or Seller. Redpoint does not make, and should not be construed as having made, any representation or warranty of any kind concerning any of the offered assets or offerings, including without limitation any representation or warranty regarding the quality, safety or legality of the offered assets, or the truth or accuracy of any offerings.

Redpoint makes no representation or warranty of any kind as to the ability of either Bidder or Seller to complete a sale in accordance with these Terms and Conditions or otherwise, and in accordance with any additional terms and conditions specific to a particular auction.

Redpoint does not have the power to transfer title of any assets offered by Sellers.

Redpoint may at its sole discretion to block any User who does not comply with the Terms and Conditions.

In the event of any dispute regarding any transaction conducted through use of the Services or the Website the User hereby releases Redpoint, its partners and subsidiaries, and their respective directors, employees, agents and successors in title and each of the foregoing, from any and all manner of action or claim  and from any and all losses, damages, costs or expenses, including without limitation court costs and legal fees, which User may have against the Released Parties.

In particular, Redpoint shall not be held responsible for any loss, damage or cost or expense arising from the use of the Service, or in Redpoints' failure to provide The Service. The Service is not guaranteed to be error free or to be available at any time.

1. Généralités:
Ceci est une vente aux enchères par internet organisée par Warin Global Investments S.A. (ci-après dénommé WGI) et son partenaire Redpoint Consulting Limited (ci-après dénommé Redpoint ou https://auctions.live-bidder.com).
Les présentes conditions générales de vente s’appliquent à toutes personnes participant aux ventes aux enchères de monnaies organisées sur le site internet par WGI.
Faire une offre d’achat ou une enchère implique l’acceptation intégrale et sans restriction tant des présentes conditions que de celles de Redpoint consultables sur le site 
 
2. Enregistrement :
Chaque personne désirant participer à la vente en Live ou placer des ordres d’achat avant la vente via Redpoint doit être enregistrée sur le site dans la section réservée à WGI. Il est conseillé de s’inscrire au plus tard 12 heures avant la vente afin que les références commerciales puissent être vérifiées.
Si des personnes souhaitent placer des offres par un autre moyen il est de leur responsabilité de produire dans les temps des références commerciales vérifiables.
 
3. Déroulement des enchères :
Les enchères sont effectuées en Euro pour les ventes labelisées « World » ou « Multiple Lots » et en USD pour les ventes labelisées « USA ». La vente suit l’ordre des numéros du catalogue. Les prix indiqués au catalogue sont les « prix de départ ». Durant la vente, les prix de départ peuvent être supérieurs au prix de départ mentionné dans le catalogue en fonction des ordres d’achat reçus avant la vente. Les ordres d’achat inférieurs au prix de départ ne seront pas pris en considération. WGI se réserve le droit, à tout moment et à son entière discrétion, de refuser une enchère, de retirer un lot ou de le rouvrir.
Le lot sera adjugé à l’enchère la plus haute (qu’elle soit placée par écrit avant la vente ou en Live durant la vente) et oblige l’acheteur à accepter les lots au prix d’adjudication incrémenté des taxes et frais applicables. Durant la vente, le message ‘Fair Warning’ est clairement affiché sur l’écran de l’enchérisseur pendant quelques secondes. A l’extinction de ce message, le lot est adjugé. L’enchérisseur est ainsi encouragé à placer sa dernière enchère dès l’apparition du message ‘Fair Warning’. Le placement d’une enchère durant l’apparition de ce message annule ce dernier qui réapparaîtra quelques secondes plus tard. L’adjudication sera attribuée par préférence par ordre de réception et d’acceptation des offres.
 
4. Ordres d’achat :
Des ordres d’achat peuvent être placés avant la vente. Ils doivent parvenir à WGI sous une forme écrite quelle qu’elle soit. A savoir par email, par fax, sur papier, via les sites Redpoint, Sixbid, Numisbids ou via ou tout autre site permettant de transmettre des offres pour nos vente. Les ordres d’achat sont acceptés jusqu’à 4 heures avant le début de la vente. En cas d’ordres placés par une personne inconnue de WGI ou de ses partenaires, WGI se réserve le droit de refuser un ordre d’achat ou de demander un acompte à l’enchérisseur.
Transmettre un ordre d’achat implique l’acceptation inconditionnelle de l’achat du lot concerné au prix d’adjudication (tant que celui-ci est inférieur ou égal au montant de l’ordre écrit) incrémenté des différents frais et taxes éventuels. Si nous disposons de votre adresse email, vous recevrez une confirmation de la réception de votre offre d’achat par email.
Un ordre d’achat peut être augmenté jusqu’à 30 minutes avant la vente. Si un enchérisseur veut diminuer ou annuler un ordre d’achat l’acheteur doit en faire la demande par écrit au plus tard 4 heures avant la vente. WGI ou l’un de ses partenaires confirmera son acceptation ou son refus par écrit.
WGI se réserve le droit de refuser un ordre d’achat à tout moment et sans en donner la raison.
 
5. Types de ventes :
WGI organise différents type de ventes aux enchères et propose tout type de matériel.
Dans le cadre de son activité numismatique WGI organise des ventes numismatiques en devise et des ventes d’investissement (ou bullion).
a) Ventes numismatiques en devises :
Elles sont généralement organisées en EUR. Toutefois, WGI peut organiser des ventes dans d’autres devises. Une vente donnée n’utilise qu’une seule devise.
Les incréments sont indiqués sur le site de la vente.

Durant ces ventes une commission acheteur est perçue sur le montant adjugé.

b) Ventes d'investissement (bullions):
Pour ces ventes le prix de chaque lot est basé sur la quantité de métal fin (pur) qu'il contient.
Un même lot ne peut contenir plusieurs métaux différents. Un lot contient un ensemble de monnaies dont certaines peuvent avoir une valeur numismatique ou un état de conservation qui augmente la valeur du lot.
Le prix des différents métaux est arrêté et annoncé une demi-heure avant la vente en fonction du prix du marché. Il ne varie pas pendant toute la vente.
La vente se déroule en pourcentage de ce prix. Cela signifie que les offres placées avant ou pendant la vente se font en % selon le tableau d'incréments ci-dessous. Le prix d'ouverture est donné en %.
Bien que les enchères se déroulent en % l'équivalent en devise est affiché en permanence durant la vente.
L'adjudication du lot se fait en % et en EUR. Le montant facturé est en EUR.
Dans le cas des ventes en US$ (ventes USA) l'adjudication et la facturation se font en US$.
Incréments:
100 - 105%: 0.2%
105 -  110%: 0.5%
110 - 120%: 1.0%
120 - 150%: 2.0%
150 - 200%: 5.0%
Au dessus de 200%: 10%
Durant ces ventes aucune commission acheteur n'est perçue sur le montant adjugé (taux de 0%).

6. Commissions et taxes :
Différents frais et taxes sont à la charge de l’acheteur en sus du prix d’adjudication.
Commission et TVA:
Le prix d’adjudication est exonéré de TVA.
Une commission acheteur est ajoutée au montant facturé du ou des lot(s) acquis et fait partie intégrante du montant dû.
Cette commission est considérée comme un service et de ce fait soumise à la TVA. Cela signifie que si l’adresse de livraison se trouve dans l’union européenne la commission acheteur inclura une TVA de 17% (uniquement sur la commission). C’est le montant de commission TTC : Si les lots sont exportés ou que l’acheteur fournit avant la vente un numéro de TVA intracommunautaire il est exempté de TVA et le montant de la commission est le montant HT .
Pour les ventes numismatiques en devises la commission est de 18 % HT (21.06% TTC).
Pour les ventes d’investissement (bullions) la commission est de 0%
TVA sur la marge :
WGI applique le principe de la TVA sur la marge. Les lots concernés sont mentionnés dans la description du lot et sur la facture par un signe (*). La société WGI définit les lots qui répondent à ce principe et en assume l’entière responsabilité. Cela exclut de fait toute responsabilité ou contestation de la part de l’acheteur, du déposant ou des partenaires de WGI ainsi que de leurs représentants.
Droits de douane et autres taxes :
Il est de la responsabilité de l’acheteur de s’assurer que l’acheminent des lots acquis est légal dans le pays de destination.
Les droits de douane et autres taxes additionnelles (par exemple les taxes liées au pays de destination) sont entièrement à la charge de l’acheteur. Il est également de sa responsabilité de s’enquérir de ces taxes auprès des autorités compétentes.
 
7. Frais d’expédition :
Les frais d’expédition sont à la charge de l’acheteur. Ces frais d’expédition sont également soumis à la TVA de 17% lorsque celle-ci est applicable.
La facture client indique le montant des frais d’expédition que WGI estime le plus adapté en fonction du montant de la facture, du pays de destination ainsi que du montant assuré et déclaré.
Dans le cas où l’acheteur souhaite une autre méthode d’expédition il doit le signaler à réception de la facture.

 
8. Paiement :
Le paiement est dû en EUR ou en USD immédiatement après l’adjudication. Dans le cas où le client souhaite un paiement en USD il doit en informer WGI immédiatement après la vente. Le taux de change est basé sur celui de la Banque Centrale Européenne le jour de la vente.
Le montant dû est le montant adjugé additionné de la commission, des frais d’expédition et autres frais ou taxes éventuels.
L’acheteur est personnellement responsable de son ou ses achat(s) et agit par conséquent en son nom propre et ne peut prétendre avoir agi pour le compte d’un tiers. Il est personnellement responsable du paiement de l’intégralité de la facture et des autres frais ou taxes éventuels.
Les lots ne seront envoyés ou remis qu’après le paiement intégral de la facture. Le délai maximum de paiement est de 30 jours à compter de l’émission de la facture.
Le paiement peut se faire par virement bancaire soit en USD sur notre compte en USD soit en EUR sur notre compte en EUR. Il peut également se faire par PayPal selon des conditions à nous demander.
L’intégralité des éventuels frais bancaires ou de PayPal sont à la charge de l’acheteur.
Un intérêt de retard de 1.5% par mois sera perçu pour tout retard de paiement.
 
9. Expédition :
Dès l’adjudication, tous les risques afférents au(x) lot(s) adjugé(s) seront transférés à l’adjudicataire dans leur intégralité et sans la moindre réserve.
L'envoi des lots adjugés sera effectué, après paiement, aux frais, risques et périls de l’acheteur.
Le transfert de propriété du ou des lots adjugés ne sera effectif qu’après paiement intégral de la facture émise à l’issue de la vente.
L’immobilisation des lots durant le transport suite à un défaut de paiement de taxes ou frais additionnels est de la responsabilité de l’acheteur et n’engage en aucun cas WGI.
WGI n’est en aucun cas responsable de l’immobilisation des lots suite à un cas de force majeur.
 
10. Droit de retour et de rétractation :
L’enchérisseur participe en ligne à une vente aux enchères et n’effectue pas un achat dans un magasin en ligne ou dans un autre type de commerce en ligne. Il n’y a pas de droit de rétractation après la vente.
Les lots peuvent-être examinés sur rendez-vous jusqu’à 24 heures avant la vente. Des précisions, photos détaillées ou toute autre information pouvant aider une personne à décider du montant éventuel de son enchère sont à demander jusqu’à 24 heures avant la vente.
La description et l’état de conservation des monnaies ont été rigoureusement étudiés et sont donnés en toute conscience et bonne foi. WGI garantit l'authenticité des monnaies.
L’acheteur dispose d’un droit de retour de 14 jours calendaires à dater de la réception des monnaies. Il ne peut exercer ce droit de retour que si la description diffère d’une manière évidente des lots reçus. Dans ce cas les monnaies doivent être retournées aux frais de l’acheteur. WGI remboursera le montant payé initialement après s’être assuré qu’aucune déprédation n’est intervenue entre l’envoi des monnaies et leur retour.
Des réclamations pour des lots multiples ne peuvent pas être acceptées.
 
11. For Juridique :
Tout litige découlant des présentes conditions générales est de la compétence exclusive des tribunaux d’arrondissement de Luxembourg. Toutefois WGI se réserve la faculté de saisir les tribunaux du domicile de l’acheteur.
En cas de litige, seule la version française des conditions générales fait foi.

WGI se réserve le droit de modifier ces conditions générales en tout temps, à sa seule discrétion et sans informations préalable



TERMS & CONDITIONS OF SALE

1. Overview:
This is an internet auction organized by Warin Global Investments SA (hereinafter referred to as WGI) and its partner Redpoint Consulting Limited (hereinafter referred to as Redpoint or ).
The present terms & conditions apply to all persons participating in the coin auctions organized by WGI on the website https://auctions.live-bidder.com.
Placing a pre-bid or a Live bid implies full and unrestricted acceptance of both these terms and the Redpoint’s ones available on the website 
 
2. Registration:
Anyone wishing to participate Live in the auction or place orders prior to the auction via Redpoint must be registered on the site in the section reserved for WGI. It is recommended to register no later than 12 hours before the sale so that the commercial references can be verified.
If people wish to place offers using any other method, it is their responsibility to produce in time verifiable commercial references.
 
3. Auction process  :
The bids are made in Euro for the sales labeled “World” or “Multiple Lots” and in USD for Sales Labeled "USA". The sale follows the order of the catalog numbers. The prices listed in the catalog are the “starting prices”. During the sale, the starting prices may be higher than the starting prices mentioned in the catalog based on the purchase orders received before the sale. Purchase orders lower than the starting price will not be taken into consideration. WGI reserves the right, at any time and in its sole discretion, to refuse a bid, withdraw a lot or reopen it.
The lot will be adjudicated at the highest bid (whether placed in writing prior to the sale or in Live during the sale). The buyer is obliged to accept the lots at the adjudicated price incremented by applicable taxes and fees. During the sale, the message ' Fair Warning' is clearly displayed on the bidder's screen for a few seconds. At the end of this message, the lot is adjudicated. The bidder is thus encouraged to place his last bid as soon as the message ' Fair Warning' is displayed. Placing a bid during the display of this message cancels it. It will reappear a few seconds later. In case of equal bids, the lot will be adjudicated to the first accepted bid placed at this amount (precedence).
 
4. Written bids:
Written bids can be placed before the sale. They must be sent to WGI in any written form. Namely by email, fax, on paper, via the websites Redpoint, Sixbid, Numisbids or via or any other website where bids can be placed for our auctions. Written bids are accepted until 4 hours before the auction starts. In the case of written bids placed by a person unknown to WGI or its partners, WGI reserves the right to refuse a purchase order or to request a deposit from the bidder.
Placing a written bid implies unconditional acceptance of the purchase of the mentioned lot at the adjudicated price (if this price is lower or equal to the written bid) incremented of the various fees and possible taxes. If we have your email address, you will receive a confirmation by email of your purchase orders.
A purchase order can be increased up to 30 minutes before the sale. If a bidder wants to lower or cancel a written bid, he must make the request in writing no later than 4 hours before the sale. WGI or one of its partners will confirm its acceptance or refusal in writing.
WGI reserves the right to refuse a purchase order at any time and without giving the reason.
 
5. Types of auctions:
WGI organizes various types of auctions proposing different kind of material.
As part of its numismatic activity WGI organizes numismatic sales in currency and investment sales (or bullion).
a) Numismatic sales in currency:
They are usually organized in EUR. However, WGI can organize auctions in other currencies. A given sale uses only one currency.
The increments are indicated on the site of the sale.

During these sales a buyer’s premium based on the adjudicated price is added to it.

b) Investment sales (bullions):
For these sales the price of each lot is based on the amount of fine (pure) metal that it contains.
The same lot cannot contain several different metals.
A lot includes several coins, some of them may have a numismatic value or a condition who increases the lot value.
The price of the different metals is defined and announced half an hour before the sale according to the market price. 
It is fixed for the all auction.
The sale is called with a percentage of this price. Thee opening price is given in %.
Although bids are placed in % the equivalent amount in currency is permanently displayed during the sale.
Lot is adjudicated in % and in EUR. The invoiced amount is in EUR.
If the sale is a US sale adjudication is in % and US$, invoiced amount is in US$.
Increments:
100 - 105% : 0.2%
105 - 110 %: 0.5%
110 - 120 %: 1.0%
120 - 150 %: 2.0%
150 - 200 %: 5.0%
Above 200%: 10.0
During these sales no buyer's premium is charged on the adjudicated amount.

6. Premium and taxes:
Different fees and taxes are charged to the buyer in addition to the hammer price.
Buyer’s premium and VAT :
The hammer price is VAT exempted.
A buyer's premium is added to the invoiced amount of the lot(s) bought and is an integral part of the amount due.
This buyer’s premium is considered as a service and therefore subject to VAT. This means that if the delivery address is in the European Union the premium will include a VAT of 17% (only on premium). This is the premium amount including VAT. If the lots are exported or if the buyer provides before the sale an EU VAT number he is VAT exempted and the amount of the premium is the amount excluding VAT.
For Numismatic auctions in currency buyer’s premium is 18%  excluding VAT (21.06% including VAT).
For investment auction (bullions) buyer’s premium is 0%
VAT on the margin:
WGI uses the principle of VAT on the margin. The lots concerned are mentioned in the lot description and on the invoice by a sign (*). WGI defines the lots that meet this principle and assumes full responsibility for this choice. This excludes any liability or dispute on the part of the buyer, the consigner or WGI partners and their representatives.
Customs duties and other taxes:
It is the buyer’s responsibility to ensure that the shipped lots are legal in the country of destination.
Customs duties and other additional taxes (e.g. taxes related to the country of destination) are entirely the responsibility of the buyer. It is also his responsibility to inquire about these taxes from the competent authorities.
 
7. Shipping costs:
Shipping fees are charged to the buyer. These shipping costs are also subject to 17% VAT when applicable.
The customer invoice indicates the amount of shipping charges that WGI considers the most appropriate based on the amount of the invoice, the country of destination and the amount insured and declared.
In case the buyer wants another method of shipping he must report it upon receipt of the invoice.

 
8. Payment:
Payment is due in EUR or in USD immediately after the lot’s adjudication. If the buyer prefers a payment in USD, he has to inform WGI immediately after the sale. Exchange rate is based on the European Central Bank’s one on the auction day.
The amount due is the amount adjudicated plus buyer’s premium, shipping costs and any other fees or taxes.
The buyer is personally responsible for his purchase(s) and therefore acts in his own name and cannot claim to have acted on behalf of a third party. He is personally responsible for paying the entire invoiced amount and all other fees and taxes.
The lots will be sent or delivered only after full payment of the invoice. The maximum payment period is 30 days from the issuance of the invoice.
Payment can be made by bank transfer either in USD to our USD account or in EUR to our EUR account. It can also be made through PayPal. Please ask us for specific terms related to PayPal.
The potential banking or PayPal fees are fully at the buyer’s charge.
An interest of 1 .5 % per month will be charged for any late payment
 
9. Shipping:
As soon as the lot is adjudicated, all the risks related to this adjudication will be transferred to the successful bidder in their entirety and without any reserve.
Shipping of the won lots will be done, after full payment, at the own expenses and risk of the buyer.
The transfer of ownership of the lot(s) won will only be effective after full payment of the invoice issued at the end of the sale.
The immobilization of the lots during the transport following a non-payment of taxes or additional expenses is the responsibility of the buyer. WGI doesn’t assume any responsibility in any case for it.
WGI is in no way responsible for the immobilization of the lots following a case of force majeure.
 
10. Return right and retractation:
The bidder participates online in an auction and does not make a purchase in an online shop or any other trading on-line system. There is no right of withdrawal after the sale.
The lots can be examined by appointment until 24 hours before the sale. Details, detailed photos or any other information that may help a person to decide of his eventual bid amount are to be requested up to 24 hours before the sale.
The description and the state of conservation of the coins have been rigorously studied and are given in good conscience and in good faith. WGI guarantees the authenticity of the coins.
The buyer has a return right of 14 calendar days from the receipt of the coins. He may exercise this return right only if the description differs in an obvious way from the lots received. In this case the coins must be returned at the buyer’s expenses. WGI will refund the amount paid initially after ensuring that no depredation has occurred between the sending of the coin and its return.
Claims for multiple lots cannot be accepted.
 
11. Jurisdiction:
Any dispute arising from these terms & conditions is in the exclusive competence of the District Courts of Luxembourg. However, WGI reserves the right to seize the courts of the buyer's domicile.
In case of dispute, only the French version of these terms and conditions prevails.

WGI reserves the right to modify these terms and conditions at any time, in its sole discretion and without prior notice.
